Users represent and warrant that submitted content does not violate applicable laws, infringe third-party rights, contain unlawful material, or otherwise violate these Terms.

12. PROHIBITED ACTIVITIES

Users may not use the Platform in a manner that violates applicable laws, infringes intellectual property rights, interferes with Platform operations, circumvents security measures, collects information about other users without authorization, deploys automated scraping technologies, distributes malicious software, manipulates affiliate tracking systems, commits fraud, engages in deceptive practices, or otherwise abuses the Platform.

DailyHaulDeals reserves the right to investigate suspected violations and take any action deemed appropriate, including account suspension, content removal, legal action, or referral to law enforcement authorities.

13. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYHAULDEALS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, RELIABILITY, AVAILABILITY, PERFORMANCE, SECURITY, OR UNINTERRUPTED OPERATION.

WE MAKE NO REPRESENTATION THAT THE PLATFORM, ITS CONTENT, RECOMMENDATIONS, OFFERS, OR COMMERCIAL INFORMATION WILL BE ERROR-FREE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYHAULDEALS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES ARISING FROM OR RELATED TO THE USE OF THE PLATFORM.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED AND INCLUDES DAMAGES RELATING TO LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, BUSINESS INTERRUPTION, PURCHASING DECISIONS, THIRD-PARTY TRANSACTIONS, OR RELIANCE UPON INFORMATION MADE AVAILABLE THROUGH THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF DAILYHAULDEALS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

15. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless DailyHaulDeals, its affiliates, officers, directors, employees, contractors, agents, successors, and representatives from and against any claims, liabilities, damages, losses, judgments, settlements, penalties, costs, or expenses, including reasonable attorneys’ fees, arising from or related to the user’s conduct, content submissions, use of the Platform, violation of these Terms, violation of applicable law, or infringement of third-party rights.

16. COPYRIGHT AND DMCA

DailyHaulDeals respects intellectual property rights and expects users to do the same.

Claims alleging copyright infringement should be submitted in accordance with the Digital Millennium Copyright Act (DMCA) and must contain all information required by applicable law. We reserve the right to remove allegedly infringing material and terminate accounts associated with repeat infringement.

17. TERMINATION

DailyHaulDeals may suspend, restrict, disable, terminate, or otherwise limit access to the Platform, in whole or in part, at any time, with or without notice, for any lawful reason or no reason at all.

Termination shall not affect provisions that by their nature are intended to survive termination, including provisions relating to intellectual property, limitations of liability, indemnification, dispute resolution, and governing law.

18. DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER

Any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the Platform, or any interaction with DailyHaulDeals shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA).

Users and DailyHaulDeals agree to waive any right to trial by jury and agree that disputes shall be resolved solely on an individual basis.

To the fullest extent permitted by law, class actions, class arbitrations, consolidated proceedings, representative actions, and private attorney general actions are expressly waived.

19. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

Subject to any applicable arbitration requirements, users agree that any proceeding relating to these Terms shall be brought in a court of competent jurisdiction located within the State of California.

20. MODIFICATIONS TO THESE TERMS

DailyHaulDeals reserves the right to revise, amend, update, modify, supplement, or replace these Terms at any time.

Changes become effective upon publication on the Platform unless otherwise required by law. Continued use of the Platform following publication of revised Terms constitutes acceptance of the updated Terms.
